George W. Grant of the 88th Pennsylvania had this to say on the event, which took place in mid-afternoon on 1 July 1863: "Colonel Wheelock, 97th N.Y. regiment, to the immediate left of our company, was attracting the sharpshooters' fire. His command had captured a flag in the recent charge and he stood defiantly waving it at the foe. Gen. Baxter, seeing this, ordered the colors sent to the rear for safe keeping, but the colonel would not comply, saying 'my regiment captured these colors and will keep them.' He was ordered under arrest, when he called the captain of his right company, a noble specimen of manhood, and placing the staff in his hands, he ran his sword through the flag, tearing it from the staff; then he waved the torn banner and the captain the staff, in a taunting manner, when the captain received a ball in the forehead and fell dead. ... The man having in charge the colors captured by the 97th was made a prisoner and the losers again became possessed of their flag, though in a ragged condition, so that the captors did not garner the trophy." -- Apparently the remaining part of the 20th's flag was retained by the 97th when it retreated. The New York Times article of 2 July 1913 describes the return of the 97th's portion (which had 27 bullet holes in it) to J. D. Irwin, reputedly the same color bearer of the 20th who gave up the banner at Gettysburg a half century earlier. Incidentally, it was the 45th North Carolina of Junius Daniel's brigade that recaptured the portion of the 20th's colors in the late afternoon of 1 July 1863, as described by BGen Daniel in his official report.
