Unfortunately, the unit history texts in the Civil War Soldiers and Sailors System were taken mainly from Crute's unit histories, which have a lot of mistakes when it comes to the units of the First Kentucky "Orphan" Brigade.

"5th Regiment, Kentucky Mounted Infantry
5th Infantry Regiment, assembled during the late summer of 1861, included Freeman's Kentucky Infantry Battalion. Its members were raised in the counties of Pendleton, Breathitt, Morgan, Magoffin, Bath, Owen, Grant, Jessamine, Henderson, Harrison, Shelby, and Franklin. Being a twelve-month unit, when it became time to reenlist some of its members refused and were transferred to the 9th Kentucky Regiment. Later men of the 5th did reenlist for the duration of the war. It became part of the Orphan Brigade or Louisville Legion. The regiment reported 134 casualties in the Battle of Shiloh , then was active at Baton Rouge before being assigned to Kelly's and J.H. Lewis' Brigade, Army of Tennessee. It was prominent at Chickamauga and later took an active part in the Atlanta Campaign. In the fall of 1864 it was mounted, aided in the defense at Savannah, and fought in the Carolinas. The unit had 91 men disabled at Chickamauga, totalled 201 men and 165 arms in December, 1863, and surrendered on April 26, 1865. Its field officers were Colonels Hiram Hawkins, Andrew J. May, and John S. Williams; Lieutenant Colonels John W. Caldwell and George W. Conner' and Majors Richard Hawes and William Mynheir."

Several errors here - the 12-month regiment was mustered out and another temporary organization formed, then a permanent 5th Ky. Inf. was formed, in late 1862 (October, I think). The men were not transferred to the 9th Ky. The Orphan Brigade was NOT the "Louisville Legion." The "Louisville Legion" was a name commonly applied to the 5th Ky. Inf. in the US Army. This 5th Ky. Inf. was NOT at Shiloh - that was the other 5th Ky. Inf., which later became the 9th Ky. Inf. and is usually known as the 9th (Col. Thomas Hunt's regiment). Nor was this unit (5th Ky.) at Baton Rouge. After the battle of Chickamauga, they were transferred to the Orphan Brigade and surrendered as part of that unit at Washington, GA, on 6 May 1865 (not on 26 April 1865). John W. Caldwell was not in this 5th Ky. - he was in Col. Hunt's regiment. (Yes, it all DOES get confusing!)

9th Infantry Regiment [also called 5th (Hunt's) Regiment] was organized at Russellville, Kentucky, during the fall of 1861. The men were recruited in the counties of Logan, Jefferson, Nelson, Harrison, Ohio, and Scott. It became part of the Orphan Brigade or Louisville Legion. The 9th served under Generals Hanson, Helm, and J.H. Lewis. It fought at Murfreesboro, was active in and around Jackson, saw action at Chickamauga, then participated in the Atlanta Campaign. During the fall of 1864 it was mounted and took part in the defense of Savannah and the campaign of the Carolinas. The regiment lost 1 killed and 28 wounded at Murfreesboro and forty-four percent of the 230 engaged at Chickamauga. In December, 1863, it totalled 235 men and 157 arms, but only a remnant surredered with the Army of Tennessee. The field officers were Colonels John W. Caldwell and Thomas H. Hunt; Lieutenant Colonels Alexander Casseday, Robert A. Johnston, and J.C. Wickliffe; and Major Ben Desha."

Some of the same errors here - NOT the "Louisville Legion." The 9th Ky. Inf. did not surrender as part of the Army of Tennessee in North Carolina, but later in GA.
