John Fearn was never married to Ellen Malley in Tasmania. She married a gentleman named Brawdie, and obviously Fearn and Malley left Australia under suspicious circumstances. The evidence is available at the Tasmanian Archives. Malley herself was, like Fearn, a convict, but Brawdie was a free settler. There is no record that she was ever divorced, so it is obvious she left under a cloud, probably eloping to the U.S. Fearn himself was never an Australian. He was born in England and came to Australia as a convict, leaving only a few years later, under a cloud. He was no more an "Australian" than was the famous general, Thomas Francis Meagher, who was only here briefly as a convict, and is considered as an Irish American. All the facts speak for themselves. It takes proper research to show these facts. Just like John McBride, who was in the 38th New York Infantry, was actually killed in action at First Bull Run, and therefore cannot be buried in New Zealand.
