General Order No. 5 could be any of a myriad of orders issued at the regimental, brigade, division, district, department, state, or national level. That being said, you should realize that the state level general order mentioned likely isn't the one referred to in that letter as the Crescent was originally a 90 day loan to the Confederate government of a militia outfit themselves. As for militia units not seeing action, that doesn't hold water either. Besides the Crescent, the Chalmette and La Fourche Regiments immediately come to mind as militia organizations who had battles on their resumes. Far from the other off-subject scenario proposed.
