Levi T. Butler, "D" 12th Ms. Inf.

I am looking for a better identification of the above soldier. Does anyone have easy access to enlistment information showing age etc? It's an interesting quest.
A Levi T. Butler was from Smith County, Texas from a wealthy but anti-secession family. In 1861 he was indicted for Treason in that he made anti seccession statments. In 1863 the indictment was dismissed as the defendant had been "killed at Sharpsburg" The only Texas units at Sharpsburg were the 1st, 4th, and 5th, and he does not show on any of their rosters. The only Levi T. Butler in ths soldiers and sailors system that could be this person is the one in the 12th.
My thoughts are that he fled Texas, enlisted in this unit and was killed. Looking for confirmation.
