You said in your original post that Section 3 of the 14th Amendment was removed.

I am not saying that the disability imposed by section 3 was not removed from ex-Confederates as provided for in section 3. What I am saying that Section 3 itself has not been removed from the 14th Amendment and is still the law. An Amendment cannot be repealed by a simple act of Congress, it must be repealed through the Amendment process - example: the 18th and 21st Amendments. Section 3 does not say "shall have engaged in insurrection or rebellion...FROM 1861 to 1865." If Idaho were to break out in rebellion today, section 3 would apply to them unless and until Congress by a 2/3 vote removed the disablility incurred by participating in said rebellion.
