IIRC the Battle Flag was something Beauregard and Johnston came up with in the latter part of 1861. The Confederate Congress had nothing to do with it, but they did make it part of the Second National flag in 1863. Prior to that time there's no mention of it in the Journals of the Confederate Congress.
