There really isn't an issue here.

Soldiers deserting from Confederate units and later joining Federal commands do exist. However, records show Madison Johnston on roll with his Confederate command from mid-summer of 1862. The Federal unit mentioned had just begun recruiting at this time. Since Madison Johnston who served in the 3rd Confederate Cavalry was killed in action or died as a result of wounds during the Battle of Murfreesboro, he could not have enlisted in U.S. service at a later date.
