Bettye....assuming you meant 1858 rather than 1958.

I'm not sure if that was the basis for the continuing "Home Guard" programs. As a kid in WWII one of my best friends father...who like my father was "too old" [over draft age] ... to serve in the active military was a member of the Texas Home Guard unit in the Port Arthur area shortly after Pearl Harbor. I remember his "gear" included an old WWI style doughboy helmet, an '06 Springfield rifle, lace-up canvas leggings and the usual pack/pistol belt/canteen rig. His son and I use to sneak those out to "play war" when his Dad wasn't around.

There were, and are, a number of states that had a "state militia," and/or "Home Guard"...separate and apart from their National Guard and the normal military reserve units.
These were/are authorized by "militia" provisions under their respective state constitutions, under the control and authority of the respective Governors and not subject to being federalized or deployed outside of state borders as a military unit (unless recent homeland security legislation has changed that)...which sounds similar to the governing laws during the WBTS era.

I'm wondering if Texas still has an authorized "Home Guard" of that nature (not the National Guard or Army Reserve units) on the books?
