There must have been some problem regarding his service as intimated by his resignation statement, " I desire that my resignation should be acted upon as promptly as the nature of the case will warrant." Jan. 8

A January, 1865 roster of officers of the 17th Virginia Cavalry reveals that he was under arrest for drunkness, ordered to Division Hd. Qrs. In arrest by order of Maj. Gen. Lomax. He was recorded on the Dec. 1864 muster roll as "Present in arrest." Previously on April 30, 1864 he is noted as under arrest.

Resignation Respectfully forwarded, approved. I think the service would be very materially benefited by the acceptance of his resignation. J. A. C , Capt. Comd'g. Jan. 13

And then the endorsement by Brig. Gen. John McCausland, "Respectfully approved. This officer is worthless & inefficient. This should be accepted at once." Jan. 14.

Approved L. L. Lomax, Maj. Gen. Jan. 14

Res. forwarded Fitz Lee, n.d.

Res. approved J. Early Lt. Gen. Jan. 13

Acceptance recommended for Gen. R. E. Lee, Jan. 25

Resigned February 4, 1865

Special Order No. 29 must pertain to his resignation and might probably be found at the National Archives in Washington, DC. However, it might involve some research as we do not have the ID of the Command from which it was issued.

They were at the time attached to McCausland's Brigade, Ransom's/Lomax's Division, Valley District Corps., Dept. of Northern Virginia
