The regiment could not have been involved in battle in Virginia during May 1862. Regimental returns report most companies assigned to the 38th Georgia divided between camps situated around Atlanta and Savannah. However, W. W. Kirkland's company was being reorganized in Henry County AL at that time. Muster rolls show W. W. Kirkland's date and place of enlistment as May 10, 1862, Franklin AL.

If I'm not terribly mistaken, Lawton's Brigade arrived in Virginia during the second and third weeks of June 1862.
