It is not at all uncommon for Civil War records (and even newspapers of the day) to refer to the counties in the eastern Cherokee nation as being "in Arkansas" or someone who lives there to be "from Arkansas". I don't know if that's the explanation for your delimma but it's the one that first comes to my mind.
