Most of the 9th Kentucky's casualties occurred on 31 December (they were held in reserve during the great charge on 2 January, and apparently took no casualties that day), but Lts. Beale and Kennard were wounded on 29 December, in one of the preliminary actions leading up to the main battle. On the 31st, skirmish actions in front of Breckinridge's Div. led to the loss in the 9th KY of 6 officers and 23 privates wounded, and Lt. Curd killed. (Report of Col. Trabue, commanding the Brigade after Gen. Hanson's death - given in Ed Porter Thompson's "History of the Orphan Brigade," 1898, pp. 193-198). This adds up to more than the 1/28 listed later in the report, but no names are given other than some of the officers shown in Lanny's listing.

Both John Jackman (William C. Davis, "Diary of a Confederate Soldier," 1990) and Johnny Green (Albert D. Kirwan, "Johnny Green of the Orphan Brigade," 1956) report that Adj. Henry Curd was killed instantly when struck by a cannon ball that almost cut him in two.
