Alexander Empfield, Private, Company K, 5th Regiment Missouri State Militia Cavalry (2nd Organization), enlisted April 19, 1862 listed on April 10, 1863 as absent, on daily duty guard, recorded absent sick in Hospital at Waynesville, Mo., August 26, 1863, remaining so through the end of the year, discharged April 28, 1864 at Rolla, Mo. on Surgeon's Certificate of Disability, description on enlistment: 32 year old Farmer, born in Pencilvania [sic], 5' 9-1/2", dark complexion, blue eyes, dark hair, his disability contacted in the lines of duty on the 25th day of August, 1863 by a gun shot in his right arm in a skirmish with a band of guerrillas in Palasky Co., Mo. which deprives him of the use there of

Surgeon's Certificate: I certify, that I have carefully examined the said Alexander Empfield, Private, of Capt. Wm. ??'s Company, and find him incapable of performing the duties of a soldier because of Archylosis [sp?] of the right elbow and shoulder joint. Atrophia of the same limb, the consequences of a gunshot wound received in action, has lost the use of that limb. Is not fit for the Invalid Corps. Degree of disability 3/4

Company Muster Roll for July & Aug., 1863, shows station of company at Rolla, Mo.

"In complying with a detail order from Hd. Qrs. 5th Cav., M. S. M. August 21st, 1863, Sergt. Wm. R. Kitchen in command of 20 men to escort train from Rolla to Levenon [sp?], Mo. on the 25th day of Aug. 1863 On their way of return being attacked about 4 miles S. W. Waynesville on the Springfield road by surprise from the ambush by a band of Robber and Guerrillas comdg. by Gen [?] called called Col. Wm. R. Tucker comdg. 5th Rgt. Mo. Rangers C. S. A. disguised in U. S. Uniform Alles a grate number of his men were armed with 2 revolvers each some holster pistols and sabers the gurillas being placed next the road in an ambush thicket at the opposite, site a kind of open pararia while our man oposit of them with in 10 or 15 paces they commenced firing and charging on to the men to which the Sergt. believed that they were some of our own party as the being like wise clothed this fritening and alarming their horses which completely disordered and enabled the Sert to form his men upon which the Guerillas charged among and shattered the men excepting 7 whom being a good distance in the rear with the wagon the losts on our side are as follows 2 mortally wounded 1 missing 2 taking prisoner and paroled by said Col. Tucker (horses as Private Property E. Stephans horse killed ded J. C. Thicls, B. Geer, T. Reynold being taken by said Guerilla Band also 4 saber belts and plates, 2 pistol 2 carbine cartridge boxes 4 cap pouches 6 Pattingill and 1 Savage revolver, 6 belt holsters clothing 3 blouse 1 pr pants, 3 blankets 1 pr. boots, 3 shirts, 7 hats all lost and taking fromsaid attack also* on the 27/9 inst. wer atack by said band on to Capt ???? with 3 men escorting stage between Little and Big Paney by an swimming force was repulsed lost one horse shot in the ???? & 1 man captured and paroled by Col. tucker on Paid Day"

AUGUST 25, 1863.--Skirmish near Wayneville, Mo.

Report of Maj. Waldemar Fischer, Fifth Missouri State Militia Cavalry.

WAYNESVILLE, MO., August 25, 1863.

An escort of 14 men, coming back from Lebanon, was attacked 4 miles from here by 25 rebels. They killed 1 of our men and wounded 1; both are here. I have sent 35 men, under Captain [G.] Muller, in the direction of the California House, and 14 men in another direction. Mr. McCain brought in the wounded man and the killed.
