Re: 1864 military inquiry : Smith Garrison

January February Muster role card states he deserted from Camp Schaefer Feb 8 1862 Owing $59.25 for ordanance and $32 for horse equipment, translate that to mean he rode off with his gun and saddle. The March April entry repats the entry and adds $100 charge for the horse.

His name was placed on a list of deserters that owed the US money forwarded to the Provost Marshall office on March 14, 1864. Essentially the equivalent as an arrest warrant.

He appears on the muster out roll of Co G, 2nd Cav dated Sept 15, 1864 as dester feb 8 1862 Columbia MO owing US total of $225.05.

In the record of the proceedings of court of Inquiry held Kansas City MO June 25, 1864 he was charged with desertion and bushwacking.

At the time of the inquiry Mrs. Ruth Anne Roberts was called as a prosecution and stated she had known him from Clay Co from the age of 2 or 3. She claimed he stole a pair of gloves from a Dr. Hall of Clay County moving to Ray County 4 or 5 years before joining Merril's Horse. He apparently hid in Illinois for anumber of months returning to his fathers house to be arrested and returned to his unit. He deserted a second time and landed in Witchita Kansas. He then enrolled in the militia and deserted from that unit flitting back and forth between Levenworth KS and Richmond MO speculating in anything. He and a fellow named Jones apparently were drawing revolvers on men at night and taking their money. He asked her daughter to marry him and tried to talk her into selling her farm and giving him the proceeds. He offered to keep her as a lady and that she and her daughter would not want for anything when they moved to Sacramento. Her husband had gone to Mexico and expected to return to find everything in order and she declined his offer. He then made a number of threats against the Roberts clan and claimed to be running arms and beef for Quantrell. She then claimed he took up residence in the bushes between Randolph and Buckeye MO disrupting the federals around Liberty. Further in the statement it appears that Garrison and the Robert's daughter were "married" from Dec 15th 1863 to Jan 12, 1864 when the father returned from Mexico and put a stop to it.

She relates that Garrison reports that 2 of his boys got hanged at White Cloud and one got away because he was an Indian. He also threatened to kill and did ambush and wound a Mr Sagwell a militia soldier and family friend.

His physical description at time of enlistment is given as being 19 years old, dark haired blue eyed light complexion, 5 feet 10 inches born Washington Indiana.

The court of inquiry recommend court-martial and he was being held in Kansas City at the time of inquiry.
