Hal,

The terms of surrender agreed upon by Gen. Robert E. Lee and Gen. Ulysses S. Grant at Appommatox Courthouse on April 9, 1865 stipulates that officers could retain their sidearms and baggage. Also that troops possessing a horse could keep it, as they would need it for Spring plowing. However I am not sure that this extended to those horses which bore the brand of the U.S. Army which had been taken in battle. All other surrenders that took place at a later date generally tended to follow the same terms. Hope this helps.
