The way I read it, he was doing what he was supposed to do and in the fashion he was supposed to do it. COngress was in recess and the need was in his opinion immediate. Therefore he put out the call and then called Congress back into session and I think at that time, Congress gave him the war time powers that he requested and needed to quell the rebellion. I know you might not see it that way, but that is the way I see it.

Maybe if the Hispanic population becomes so large in the Southwest, that they decide to seceed, the President at that time will sit on his hands and let them do so.
