Linda, all of the companies comprising the 4th and 5th Texas were briefly accepted into state service before being transferred to the Provisional Army of the Confederacy. However they were all formed and recruited in 1861. Likewise none of the companies comprising the 1st Texas were state troops. Wigfall used his influence to by pass the process.

None of the companies comprising the 1st, 4th or 5th Texas existed prior to 1861 with the exception of company L 1st Texas "Lone Star Rifles. However the men of this company who went to Virginia were a splinter group newly recruited for service in Virginia so they really don't qualify either.
