Hawthorne's 39th aka 6th Trans Miss Inf was not from NW Ark, they were from all over. He referred to it as his "conscript regiment" so it was mostly men who were forced into the service due to the new conscript law.

Brooks regiment was not in the thick of fighting and had been sent a little further south to cover the right flank of Fagan's attack on Battery D.

It is not unheard of to have a man in the unit and there be no true records of him enlisting or anything. So he may have been with Brooks and records lost or just not filled out. Lots of "maybe's" . Looks like you will just have to go with family oral tradition and the snipit of a record stating he was in Co B 6th Ark. Perhaps it was Hawthorne's. THat is about the only explanation if he was not in Brooks 34th. The compilers saw the 6th info and just put him with that regiment. The govt had these folks working on transcribing all the records and they didn't have all the info necessary to decide what units were being dealt with.

However, if he died of small pox he was probably buried on small pox island out in the middle of the river which is now underwater and gone as is his grave. But he may be in the main burying ground. I haven't looked at the records to see.
