He was Surrendered on 4/26/1865 at Greensboro, NC
He was listed as:

* Paroled 7/6/1863 Vicksburg, MS

died 4/15/1904 in Forsyth County, GA

Alberry Bruton, 1st Lieutenant, Company E, 43rd Regiment Georgia Infantry, first recorded present November 11, 1862,
captured at Vicksburg, Miss. July 4, 1863, paroled July 6, receipted for issues of clothing in April, May & June, 1864, commanding Company E, tendered his resignation March 4, 1865, under the provisions of the Act of Congress providing for the discharge of officer and enlisted men over 45 years of age, being 47 at the time, no further records

Note, He signed his resignation letter as 1st Lieutenant. I see nothing in his record recording his rank of Captain
