On April 5, 1865, McGuire received a mortal wound at Amelia Springs, Virginia - IICC, the fatal wound was to his throat. He lingered until May 8, 1865, the day his life ceased.

He is at rest in Stonewall Cemetery (within Mount Hebron Cemetery), Winchester, Virginia. Next to him lie the Patton brothers.
