Stae of Missouri, County of St. Louis:
On this 20th day of July A.D. 1863 Personally appears before me, a Notary Public duly commisioned in this County and State above Said , John R Smith, a resident of the County of Franklin in this State of Missouri, who being first duly sworn according to law, am generally accquainted with James H Barnes of Franklin County, Mo have known him for about fifteen years, have never known him to utter disloyal sentiments, or have never known him in any manner to give aid or comfort to the enemies of his government and was present on the day of his arrest and at that time did not hear him utter any disloyal statements, am aware that hunters _____ have been in the habit of encamping upon the grounds of James H Barnes and from this camp____ upon the grounds would look as though Guerrillas have encamped there. Further am positive that no Guerrillas ever encamped on his farms or ____ ____upon his premises, and I consider him a good law abiding citizen and always attending to his own _____. John R. State of Missouri, County of St. Louis

On this twentiath day of July AD 1863. Personally appears before me, a Notary Public duly commissioned and qualified for the County and State, aforesaid John D Woody a resident of St. Louis Co. Missouri who being duly sworn according to law, declares that he is personally acquainted with James H Barnes, having known him about twenty years, having lived in Franklin Co about three years, that during the fall in the months of Oct. & Nov. he encamped with a number of farmers, __ : John Shatr--- and William Dasby, L.M. Sh--c-, Tho. Lanbaum, Geo. H Lauhasse, Jno. L McBride, A. Lgite, ___ the ___ was from ____, we encamped on the farm of James Barnes on the public county road leading to Union and that in the neighborhood was a military force under command of Capt. Rucker and that he heard of no Guerillas being in the neighborhood or county and saw no evidence of ''guerrilla bands having camped on the premises of said James H Barnes, I have never heard the said James H Barnes utter any disloyal sentiments and have always regarded him as a good law abiding citizen, signed John D Woody.

Affidavit of John L. McBride in the case of James H Barnes of Franklin Co. Mo.

State of Missouri, County of St. Louis

On this the Fourteenth day of July A.D. 1863, Personally appeared be for me a Notary Public duly commissioned and qualified for the county and State ofMissouri, John L McBride, a resident of St. Louis, Mo. who being duly sworn according to law declares that he is personally acquainted with James H Barnes having known him for a number of years, that during the fall of 1861, in the latter part of the month of October and the first part of the month of November, he was in a hunting excursion and in company with L. Louhaus, J. H. Humphreys, L. M. Sh____, A Lytte, John D Woody, John Shotwell, Thomas D. P. Lauhaus, George H Lauhaus, John __. Lauhaus, John _. Heimer and son, Philip S Lauhaus, __ Jocky had with him two negroes and James Biggins and that they encamped on the farm of the said James h Barnes in Franklin county Missouri, while hunting in that vicinity, moreover near the camp of Captain Rucker, of the Regiment, said that he heard of no guerillas being in that neighborhood and saw no evidence of Guerrilla bands having camped on the premises of he said James H Barnes and from what I know of James H Barnes having known him personally for several years, believe him to be a highly honorable man and good citizen. Lt. Co; James A Broadhead, Provost Marshal Gen. District of the Missouri

Colonel;

I herewith respectfully submit the enclosed affidavits of John L McBride, constable of the city, John D Woody a citizen of this county and John R Smith a citizen of Franklin Co. Mo. in the case of James H Barnes of Franklin Co. Mo. on his parole and confined to the limits of the city of St. louis who is charged with general disloyalty, utter disloyal ____ & harboring guerrillas. Mr. Barnes is an old man of some sixty years of age a man of good character and considerable property. He was arrested on the 4th of May last , was sent to this city & held in confinement at the Myrtle Street prison until the 11th of July inst. when he was released on his parole on the application of the undersigned to Capt. Allen.

His case was referred to the military commission and it is not known whether it has yet been acted upon or not.

Mr. Barnes is very desirous of being released & allowed to go home and attend to his farming business which has suffered much in his absence. He is willing to take the ath & give bond if required so to do, but he solemnly protest his entire innocence of the charges & claims to have always been a loyal law abiding man & that he is satisfied that his arrest & charges against him have been brought about through malice, which claim is sustained by the statements of quite a number of citizens of Franklin Co & of this Co. made to the undersigned. The existence of camping grounds etc. on Mr. Barnes place from which it appears to have originated the charge of his having harbored Guerrillas, is accounted for in the affidavits of the gentlemen named above & by others who have been in the habit of hunting in that region of country & the yearly practice of quite large hunting parties camping upon his premises.
