This is a great question. I have just come into possesion of a court transcript of a case involving a soldier in Captain English's MS Battery who was trying to get of his conscription due to a medical condition, but Captain English informed him that the only way that he could due so inspite of having a medical certificate stating that he was unfit for duty was to acquire a substitute (which he did). After the war, his widow sued the substitute. I do not know the intricacies of the Confederate Conscript Act of 1862. I knew about substitutes in the North, but I am really at a loss when it comes Confederate Military Law at times.
