The incident took place in late 1862 (conscription) and he had a certificate signed by two physicians upon arrival at his muster point (Fayette,MS) stating that he was unfit for duty due to a chronic condition. He presented the certificate Genl Beall and was told to report to the brigade surgeon. That surgeon declared him unfit for service and sent him back to the genl. the genl was ready to discharge him when he was reminded the Capt English's company was an indepent battery and therefore this individual needed his signature. Captain English said (according to the transcript) this individual was needed as he was a butcher and could serve on detatched duty in that capacity. Shortly after arrival, he was sent to the post hospital and stayed there until he was informed that is he could get a furlough for the purpose of getting a substitute, he could then be discharged. The court case I mentioned in my earlier post was the widow of the individual sueing the substitute in the Adams County Chancery Court over land that was deeded to this individual as enticement to get him to take the other's place in the army. The widow, felt that she had been defrauded as the substitute only served for a few months before Port Hudson fell and he was paroled. Upon returning to MS he did not report for exchange. Did she have a leg tostand on, I have no idea and in fact think that she might have lost the case.
