Re: 3rd Confederate Cavalry Regiment, Company E

Confederate soldiers who deserted and were sent to Federal prison camps were offered release if they took the oath of allegiance to the United States and agreed to remain North of the Ohio River for the remainder of the war. It appears that Madison refused this offer. Although his records indicate that he took the Oath of Allegiance to the US while in prison, I suspect he did not. I believe that these documents were pre-filled out with names before hand and do not reflect those who later refused the take the oath. Or, he may have taken the oath, but elected to remain a prisoner for the duration of the war.

Howard, for 3 years or the war, present on the muster dated January 18, 1863, sick in hospital April 30, 1863, paid June 30, 1863, exchanged for M. Bates by order of Genl. Hardee, n.d.,

April 30 to December 31, 1863, dated December 31, 1863

Since last muster engaged in the battle of Chicamauga, loss none. Borean [?] action part in the battle of Philadelphia, Tenn. on 20th day of Oct./63, killed none, wounded 4, captured 1. Engaged the enemy at Campbell's Station, Tenn., Nov 16th/63, lost none; also at Kingston, Tenn. 24th Nov/63. Loss, one wounded and repulsed by the enemy. Engaged the enemy at Charleston,Tenn., on the 20th Dec. Repulsed with no loss.

January & February, 1864, dated Feb. 29, 1864

Since last muster engaged in picketing in front of Dalton, Ga. Engaged the enemy on the 23rd and 24th of Feb, 1864 near Dalton,Ga. Repulsed them without any loss also engaged the enemy on the 27th inst. north of Spring place, Ga. routed him with loss of one man captured and captured two (2) of the enemy. Wounded (1) man and (3) three horses. Stationed at Tunnel Hill, Ga. at the end of February.

May & June, 1864, dated June 30, 1864 at Marietta, Georgia

Engaged by the enemy May 1st and bore an active part in the fight. Monday May the 9 on the Cleveland and Dalton road. Marched to Resacca on the 11, and engaged the enemy in heavy skirmishing and were actively engaged every day until the place was evacuated and were actively engaged at every point where there was any fighting of note to Marrietta, Ga. Loss one killed and four wounded.
