Spivey may have died of wounds in Federal hands, but there is nothing in his record about being imprisoned. At this time Confederate prisoners were released on exchange, so anyone captured during the Battle of Sharpsburg would not have remained in prison more than a few months, and usually less than that.

I would advise caution in dealing with the title that you mentioned.
