Floyd faced those charges and they were thrown out in criminal court in Washington D.C. on March 7, 1861. The guns Floyd sent were all part of scheduled upgrades and the finishing of contracts to build the fort on Ship Island, MS, and at Galveston, Texas, in other words he had to due to his oath of office. Also the records show that arms sent to the South in 1860 were actually less than their normal qouta, much less than was sent to the Northern states, who by the way, were also mobilizing their state militias.
