The Militia Act of 1792, as revised in 1795, was the authority Lincoln used to call for militia. It was revised in response to the experience of the Whiskey Rebellion. As for a call to disperse, Lincoln's Inaugural Address was issued on March 4, 1861, over a month before Fort Sumter and the call for 75,000.
