Lee, earlier in the war, had won several battles where he was outnumbered. So that cannot be used as an excuse. Lee was an intelligent man. If his army was so depleted, perhaps he should have surrendered sooner to prevent bloodshed in a war he could not possibly win. Obviously, he thought he might have a chance.
