He was transferred out on 11/8/1862
On 11/8/1862 he transferred into "I" Co. CS 1st Infantry

May 16, 1916, Respectfully returned to the Commissioner of Pensions, State of Georgia, Atlanta. The records show that one J. F. Burk (also borne as Jno. F. Burk
but not found as John F. Burke), private, 1st Co. H, 26th Tennessee Infantry, which became 2nd Co. I, 1st Confederate Regiment Georgia Volunteer, enlisted July 8, 1861. On the company roll dated Aug. 31, 1863 (last on which borne), he was reported present. No later record found. Rolls on file cover period to Feb. There were no further muster rolls for his company which survived the war, thus, we have no way of following his subsequent service

Burk, age 28, enlisted as Private in Company E, 3rd Regiment Confederate Cavalry May 16, 1862 at Cleveland, Tennessee, captured at Summer Hours [sp?] [Summerhour] Mills, Murray County, Georgia April 13, 1864, sent to Camp Morton, Indiana prison camp, June 30, 1864 muster records "Prisoner in the hands of the enemy since April 13, 1864, paroled at Camp Morton and forwarded to City Point, Va., via Baltimore, Md. for exchange February 26, 1865
