The 5th Kentucky from Eastern Kentucky was within hearing of the Battle of Perryville but were guarding a bridge and were never on the battlefield.After the Confederate withdrawal thier General Humphrey Marshall was give permission to leave the state anyway he wished.He headed toward Eastern Kentucky.In thier camp at Hazel Green,Kentucky the regiments one year enlistment ran out.They agreed to reenlist for the duration of the war if Marshall would let them convert to cavalry.Marshall refused.Part of the regiment stacked thier arms and took thier discharge.The ones that stayed and reenlisted for the duration of the war formed the heart of the 5th that would become part of the Orphan Brigade.Hope this will help clear up the confusion.
