I understand your point. I was not aware of Ala law that mandated conscription of 17 year olds before the CS conscription act of Feb. 64 created the Sr. and Jr. reserves. But, even if such were in effect in late 1863 when most of these boys entered, did it extend to 15 and 16 year olds, as many if not most of this battalion were at the time? This battalion elected their officers. I don't think such privilege would have been allowed a conscript battalion. They were volunteers even if they joined in anticipation of being conscripted if they didn't (as many older volunteers did in 62 and 63). They were "State troops" under the control of the Governor and not the CS government (at least until they were designated regular infantry) and as such I guess could have been considered "Militia". But my understanding of the use of the term "Militia" as it applies to the WBTS was a "home guard" or "local defense" organization called out in times of temporary emergency and not standing organizations. Lockhart's Battalion was on permanent duty from Jan. of 64 until surrendered in May of 65. I would be much interested in finding out about the State of Ala. conscription laws. Thanks!
