Depends on a person's definition of "Confederate soldier". Could be that a local SCV chapter will allow membership based on militia service alone. Also, some Southern states might have allowed a pension claim based on the same. Most did not, limiting pension payments to veterans of Confederate service alone.

The definition being used here is the same as Art Bergeron used in his Guide to Louisiana Confederate Military Units: a Confederate soldier is a man who enlisted in military service of the Confederate States of America. He placed the Louisiana State Troops in an appendix because they were under Confederate control for a few weeks. Art repeats your statement about being "transferred" because that term was actually mentioned in orders. However, as he notes in the next sentence, "few if any of the men formally mustered into Confederate service." (p 181)

These units were on state loan to local Confederate authorities. Organizations remained exactly as they organized, which wouldn't have been permitted under actual Confederate control. For example, some miltia regiments organized with far fewer than ten companies. Also, term of service would have to change from ninety days to three years or the war.

Actually, some of these state volunteers did enter Confederate service. After the fall of New Orleans, most members of the Sumter Regiment followed orders to report at Camp Moore. At that time they formed new companies and organized the 30th Louisiana Regiment, AKA Sumter Regiment. If these men were already in Confederate service, there would be no need for any of this.
