I can understand your stance, but as a Peace Officer I was taught that the Consitution is what protects the people from abuse of the Government. Therefore the Consitution is written in stone and should never be broken even for the good of the case. I compare this to Lincoln's violating Maryland's rights. True it was easier to ship troops across Maryland, but Lincoln's excuse does not hold water as the State of Maryland said they would protect Washington D.C. from attack as it was they who gave the land to create Washington D.C. So Lincoln's necessity was a store bought excuse to do as he pleased.
I'll not get into Bush's decision's as history has yet to prove him right or wrong.
