#1. The 14th ammendment was passed after April 1865. Any crime commited before this was (not)a crime because it had not become a crime at the time committed. That is the way American Law works, it is called Expo facto. It is a legal rule set by common law. All of the United States law follow common law ruling. (Blackstone on Common Law)

You can not be punished legaly for a crime that is not a crime. This is common sense. Chase was not an idiot, he release Davis because of this. They had already violated Davis's rights for imprisoning him for 2 year without formal charges. They refused him care when he was sick. They refused him visitors. Davis was wanting to go to court because he knew what they were doing was wrong by the Consitution. Jefferson Davis was a lawyer Craig, one of the smartest Contitutional Lawyers of the time.

Now you can run through this computer and find just about anything you want that confirms your beliefs. But remember this.

Lincoln is dead. Writ of Habeus Corpus is reinstated.

The War is over at the time of Davis's Arrest. Habeus Corpus must be followed.

The Consitution must be followed.

There is no 14th Ammendment at the time of Davis's arrest.

Now any lawyer with half a brain will tell you. Davis's Consitutional rights were violated. Chase was not an idiot he saw this. To allow Davis to be tryed would be to take the chance that he will be aquited. Why? Because his Consitutional Rights had been violated for two years.

Having had to live by this rule for twenty year Craig, I know that if your rights have been violated during the actions to arrest or detaining you, the arrest or detention becomes a "fruit of a tainted tree". This nullifies the charges against you and you shall go free. I believe this is going to be under USC Title 18.
