The 14th amendment made secession a treasonable crime. Now before this secession wasn't, therefore the rule of Ex Post Facto came into play in Davis's case, by their own rules Davis couldn't betryed for treason, because at the time he was involved in secession, it wasn't a crime. If it isn't a crime, then reason would say that it is legal.
