The CSA officially declared black USA soldiers would not be considered soldiers, until the threat was made and acted upon, after Fort Wagner, either treat all captured soldiers with equal protection, or white CSA soldiers would be treated in the exact same manner USA black POWs were treated by the CSA.
In fact, the prisoner exchanges were suspended completely for a time over this issue.
